2. Booking and Cancellations

  • Cancellations: If you need to cancel your booking, please do so in accordance with our cancellation policy. Different rates or services may have specific cancellation terms which will be communicated at the time of booking. Please note that failure to cancel within the specified period may result in cancellation charges, up to the full cost of the service.

3. Payments

Payment terms, including deposit requirements and final payment deadlines, will be clearly stated at the time of booking. Payments can be made using the methods specified by us. Non-compliance with payment deadlines may result in the cancellation of your booking, and you may forfeit any deposit or payments made.

4. Travel Insurance

We strongly advise all travelers to obtain comprehensive travel insurance that covers trip cancellations, medical emergencies, and other unforeseen circumstances. It is your responsibility to ensure that you are adequately insured for the entire duration of your trip.

5. Liability

Our liability is limited to the provision of travel services as agreed upon in your booking. We are not liable for any indirect, incidental, or consequential damages, including but not limited to personal injury, death, or property damage, that may occur before, during, or after your trip.

6. Passport, Visa, and Health Requirements

Ensuring that you have valid travel documents, including passports, visas, and other necessary paperwork, is your responsibility. You are also responsible for complying with any health requirements for your travel destination. We can provide general information, but it is your duty to verify and fulfill these requirements.

7. Modifications to Service

We reserve the right to change or discontinue any aspect of our services, including website features, offerings, or pricing, without prior notice. Such changes will not affect confirmed bookings unless necessary due to circumstances beyond our control.

8. Governing Law

These Terms are governed by and interpreted in accordance with the laws of Peru, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Peru for the resolution of any disputes.

9. Changes to Terms

We may update these Terms periodically to reflect changes in our services, market conditions, or legal requirements. We will notify you of these changes through our website or other communication channels. Continued use of our services after such changes constitutes acceptance of the new Terms.

10. Intellectual Property and Use of Media

  • Intellectual Property: All content on our website and applications, including texts, images, logos, and software, is owned by Huaynas Expeditions or its licensors and is protected by intellectual property laws. This content may not be used, reproduced, or distributed without our express permission.
  • Use of Media: By participating in our tours, you grant Huaynas Expeditions the right to use photographs, video recordings, or other media taken during your trip for promotional purposes without any further approval or compensation.

11. Responsibilities of Participants

You are responsible for selecting a trip that matches your physical abilities, health status, and interests. We are available to discuss the suitability of trips based on your needs. Ensuring good health for travel, obtaining necessary vaccinations, and adhering to safety instructions during the trip are your responsibilities.

12. Itinerary Changes

We aim to operate all trips as advertised, but changes may be necessary due to various factors such as weather, local conditions, or other factors beyond our control. We will endeavor to keep such changes to a minimum and seek to provide equivalent arrangements or services. We are not responsible for any additional expenses that may arise due to changes in itineraries, such as alternate accommodations, travel costs, or other related charges.

13. Special Requests and Medical Conditions

We strive to accommodate special requests and ask you to inform us of any medical conditions that may affect your travel. Special requests, such as dietary needs or specific accommodations, should be communicated to us at the time of booking. While we strive to meet these requests, they cannot be guaranteed and may incur additional charges.

14. Complaints

If you encounter any issues during your trip, immediately notify your tour leader or our local representative to allow us the opportunity to address and resolve the issue. Should your issue not be resolved on the spot, please provide a written complaint within 30 days after your trip’s conclusion, detailing the nature of the complaint and any relevant information.

15. Liability for Damages

If you cause damage to any property or equipment used during our tours, you will be responsible for the cost of repair or replacement.

16. Linking to Our Site

You are welcome to link to our website provided it is done in a way that is fair, legal, and does not damage our reputation. However, you must not establish a link in such a way that suggests any form of association, approval, or endorsement on our part where none exists.

17. Prohibited Uses

Our website and services must not be used for any unlawful or unauthorized purposes. You must not engage in any activity that infringes on the rights of others or violates any laws or regulations.

18. Indemnification

You agree to provide accurate and complete information during the registration process and to update such information to keep it accurate, current, and complete.
  • Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account. You agree to immediately notify Huaynas Expeditions of any unauthorized use of your account or any other breach of security.
